This DEED is made the sixth day of December One Thousand
Nine Hundred and Eighty-Two BETWEEN THE PARISH COUNCIL OF ALDINGBOURNE in the County of West Sussex (hereinafter called “the Parish Council”) of the First part and HERBET GORDON HALE COLLINS of Hazledene Nyton Road Aldingbourne Near Chichester in the said County of West Sussex and MURIEL ELIZABETH WHITEHOUSE of 25 Meadow Way Westergate in the County of West Sussex (hereinafter called the Lessees which expression shall where the context so admits include their successors title) of the Second part and THE OFFICIAL CUSTODIAN FOR CHARITIES of the Third part
W H E R E A S :-
1. BY an Order (hereinafter called “the said Order”) of the Charity Commissioners for England and Wales dated the second day of June One Thousand Nine Hundred and Eighty-One the Leasehold land comprised in the Schedule to the said Order was vested forthwith in the Official Custodian for Charities for all the Estate and interest therein belonging to or held in trust for the Aldingbourne Sports and Recreational Centre
2. THIS Deed is supplemental to a Lease and Trust Deed made the Twenty-first day of May One Thousand Nine Hundred and Seventy-Nine between the Parish Council of the one part and the Lessees of the other part (hereinafter called “the Lease and Trust Deed”)
3. THE parties hereto are desirous of altering the terms of the Lease and Trust Deed in manner hereinafter appearing
NOW THIS DEED WITNESSETH that it is hereby mutually agreed as follows:
1. IN lieu of the provision in the Lease and Trust Deed that the Lessees shall not assign the demised property except to a new Trustee or new Trustees for the purposes set out in the Schedule thereto and not underlet the same nor part with possession either of the whole or any part thereof there shall be substituted the provision that the Lessees shall covenant with the Parish Council (but not so that any personal liability shall be imposed upon the Official Custodian) that they will not assign or underlet in whole or in part nor to part with the possession of the said land or any part thereof during the said term to any other person or body whatsoever provided that the Lessees shall not be in breach of this covenant if at any time they shall allow any sports club or other bodies organised for recreation purposes to have the exclusive use of the said land and any buildings thereon or to be erected thereon for the purpose of playing any game or carrying on any recreational activity
2. THE Lease and Trust Deed shall continue in full force save as modified hereby and shall henceforth operate as though the provision for assigning and under letting to a sports club or other body or bodies organised for recreation purposes which is incorporated as a Lessees covenant therein in lieu of the provision for which it is substituted and the covenants and conditions of the said Lease and Trust Deed shall have effect with regard to the assigning under letting to a sports club or other body or bodies organised for recreation purposes had been originally mentioned in the Lease and Trust Deed
IN WITNESS whereof two members of the Parish Council pursuant to a resolution of the Parish Council passed on the 2nd day of November One Thousand Nine Hundred and Eighty-Two and the Lessees have hereunto set their hands and seals the day and year first above written and the Seal of the Official Custodian for Charities was affixed to this Deed
